TERMS AND CONDITIONS OF SERVICE NORTHWEST CONCRETE CONSTRUCTION LLC 

1. SCOPE & CHANGES Work performed as specified in attached Scope of Work only. Changes require written change order signed by both parties before work proceeds.
 2. PAYMENT TERMS Deposit: 10% due at signing (non-refundable) Progress: 40% due before work starts Final: 50% due at substantial completion Due: Payment due within 10 days of invoice Late Fees: 1.5% monthly (days 11-30), then 2% monthly (day 31+) 
3. NON-PAYMENT CONSEQUENCES Work Stoppage: We may stop work if payment is 10+ days late. Mechanic's Lien Rights: If unpaid 30+ days, we may file a lien on your property under WA State law (RCW 60.04). You'll pay all lien costs including: filing fees ($500-$1,500), attorney fees ($1,500-$25,000+), court costs, and collection fees (25-40% of balance). Attorney Fees: You pay 100% of our attorney fees and collection costs if we pursue unpaid amounts. Disputes: Pay undisputed amounts immediately. Notify us in writing within 10 days to dispute charges. 
4. TIMELINE & DELAYS Timelines are estimates. Weather, material shortages, or unforeseen conditions may cause delays without penalty to either party. 
5. SITE CONDITIONS Pricing based on visual assessment. Unknown conditions (rock, utilities, poor soil, etc.) addressed via change order at additional cost. 
6. WARRANTY (1 YEAR) Covers workmanship defects only. Does NOT cover: Normal wear, cracking, color variation, or weather damage Improper maintenance or overloading Settling, freeze-thaw cycles, or chemical damage Warranty VOID if not paid in full 
7. CONCRETE CHARACTERISTICS YOU MUST ACCEPT Cracking is normal and expected - control joints direct where cracks occur, not if they occur Hairline cracks under 1/16" are acceptable Color variations and minor surface imperfections are normal Minor water pooling that drains within 24 hours is acceptable 
8. SPECIALTY FINISHES (Stamped/Colored/Exposed Aggregate) If you choose decorative finishes, you accept: Significant color and pattern variations from samples No exact matching possible Must apply and maintain sealer or warranty is void Failure to seal voids warranty completely 
9. CLIENT RESPONSIBILITIES You must: Call 811 for utility locates 48 hours before start Provide clear access for equipment Disclose all known underground utilities/systems Remove vehicles and obstacles Secure pets during work 
10. PROPERTY DAMAGE - HEAVY EQUIPMENT ACCESS CRITICAL - READ CAREFULLY: You accept ALL risk of property damage from: Concrete trucks (up to 70,000 lbs) Pump trucks, excavators, and other equipment Damage to grass, driveways, landscaping, underground systems We are NOT responsible for damage to: Lawns, landscaping, irrigation systems Existing asphalt or concrete driveways Pavers, decorative surfaces, or site improvements Underground utilities damaged by surface loading Concrete trucks belong to third-party suppliers, NOT us. For damage claims, contact the concrete supplier or pump company directly - we will NOT act as intermediary or assume their liability. Alternative: Concrete pumping reduces property access ($1,200-$1,600 extra) but doesn't eliminate all risk.
 11. SUBCONTRACTORS We may use subcontractors (excavation, pumping, etc.). They are independent businesses. You must pursue damage claims directly with subcontractors, not us. We are not liable for subcontractor damage or defects. 
12. CANCELLATION Before start: 10% deposit forfeited After start: You pay all costs incurred + 15% admin fee
 13. LIABILITY LIMITS Our total liability cannot exceed the contract price. We're not liable for indirect damages, lost use, or inconvenience. 
14. DRAINAGE & UTILITIES Minimum 1/8" per foot slope for drainage Not responsible for pre-existing drainage issues You're responsible for damage to unmarked/unknown utilities 
15. PERMITS Permit responsibility as stated in Scope of Work. You pay fees for any unanticipated required permits. 
16. DISPUTE RESOLUTION Disputes resolved through: (1) good-faith negotiation, (2) mediation, then (3) binding arbitration in your county, WA. Prevailing party recovers attorney fees and costs. 
17. PHOTOGRAPHY We may photograph completed work for marketing unless you opt out in writing.
